Terms of Service

These Terms of Service ("Terms") govern your use of the BigBoard.ai platform and website, operated by M9000 Inc. ("we", "us", "our"). By using BigBoard.ai, you agree to these Terms.

1. Service Description

BigBoard.ai is an AI-powered infrastructure monitoring platform. The service includes:

• Monitoring agents that collect system metrics from your infrastructure
• A web-based dashboard with AI-assisted natural language querying
• Alerting, visualization, and reporting capabilities
• APIs for integration with third-party tools

2. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate contact information and keep it up to date
• You must notify us promptly of any unauthorized use of your account

3. Acceptable Use

You agree not to:

• Use the service to monitor infrastructure you do not own or have authorization to monitor
• Attempt to gain unauthorized access to other customers' instances or data
• Use the platform to store or transmit malicious code
• Reverse-engineer, decompile, or disassemble any part of the platform
• Resell or redistribute the service without a written agreement
• Use the AI chat feature to attempt prompt injection or circumvent safety controls

4. Data Ownership

Your data is yours. You retain all rights to the infrastructure metrics, configurations, and other data you store in BigBoard. We do not claim ownership of your monitoring data.

You grant us a limited license to process and store your data solely for the purpose of providing the BigBoard service.

5. Multi-Tenant Isolation

Each customer account operates in an isolated instance. We maintain strict separation of customer data at the infrastructure level. In managed service (MSP) configurations, each of your end-customers also operates in a separate isolated instance.

6. Monitoring Agents

BigBoard monitoring agents are provided as compiled binaries. By deploying an agent:

• You authorize the agent to collect system metrics from the host where it is installed
• You are responsible for ensuring you have authority to install software on the target systems
• Agents transmit data over encrypted connections to your BigBoard instance
• You may uninstall agents at any time, which immediately stops data collection

7. AI Features

BigBoard includes AI-powered natural language features. These features:

• Use third-party language models to process your queries
• May provide imperfect or incomplete analysis — always verify critical decisions independently
• Are subject to the AI provider's terms and usage policies
• Do not replace professional judgment for incident response or capacity planning

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We will provide reasonable notice of planned maintenance. We are not liable for downtime caused by factors beyond our control, including network outages, hardware failures, or force majeure events.

9. Payment Terms

Paid plans are billed according to the pricing agreed upon at the time of your subscription. We will provide at least 30 days' notice of any pricing changes. Failure to pay may result in suspension of your account after a reasonable grace period.

10. Limitation of Liability

To the maximum extent permitted by law, M9000 Inc. shall not be liable for indirect, incidental, special, or consequential damages arising from your use of BigBoard.ai, including but not limited to lost revenue, data loss, or infrastructure downtime.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

• You may terminate your account at any time by contacting us
• We may suspend or terminate accounts that violate these Terms
• Upon termination, you may request export of your data within 30 days
• After 30 days, we will delete your data in accordance with our Privacy Policy

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Dallas County, Texas.
